Amicus: Planned Parenthood of Greater Texas v. Smith, Fifth Circuit Court of Appeals

Executive Summary

The National Health Law Program filed an amicus brief in support of Planned Parenthood, urging the Court to reject Texas’s effort to exclude Planned Parenthood from the State’s Medicaid program.

The amicus brief explains the importance that Planned Parenthood plays in ensuring that Medicaid beneficiaries have access to family planning services and supplies, and argues that the Court should allow individual Medicaid beneficiaries to file a lawsuit to enforce the Medicaid Act’s promise that they may seek services from any provider of their choosing that is qualified to perform the service.
