NHeLP Comments on Provider Non-Discrimination RFI
Executive Summary
Section 2706(a) of the Affordable Care Act prohibits all group health plans and health insurance issuers offering group or individual health insurance coverage from discriminating with respect to participation under the plan or coverage against any health care provider who is acting within the scope of that provider’s license or certification applicable state law.
In these comments to a Request for Information, NHeLP discusses the need for transparency, effective monitoring and efforcement of anti-discrimination provisions. Additionally, NHeLP outlines concerns over “medical management techniques” and network adequacy which can negatively impact access to important health services.
