Executive Summary

Medicaid beneficiaries in Missouri challenged a regulation which eliminated coverage for many items of durable medical equipment, such as nebulizers, catheters, suction pumps, apnea monitors, and wheelchair accessories or scooters. Coverage was eliminated even where a medical provider said the devices were medically necessary. Without this equipment, plaintiffs and individuals throughout the state were at risk of increased illness and suffering.
