Beyond the Law: The Challenges of Marketplace Coverage of Abortion in 2024

Executive Summary

A 2019 NHeLP report examined the consumer experience when seeking information about abortion coverage in Marketplace plans. Given the constantly shifting post-Dobbs landscape, it is more important than ever that insurers provide clear information to consumers about different plans’ abortion coverage.

In light of this need, we conducted an update to the 2019 study and our research shows that substantial work remains to improve information provided to consumers who are shopping for Marketplace plans. Even in states with strong legal protections, insurers continue to use stigmatizing language, voluntarily impose coverage restrictions, and provide insufficient information about the scope of coverage. This report outlines the major trends we found and provides a series of recommendations for states interested in improving the information available to consumers who are shopping on the Marketplaces.
