AMICUS: Planned Parenthood Federation of America v. Robert F. Kennedy Jr. (First Circuit)

Executive Summary

Despite the importance of Planned Parenthood clinics to the health of Medicaid beneficiaries, Congress has now enacted a law prohibiting Planned Parenthood clinics from receiving federal Medicaid funding. The National Health Law Program (NHeLP) and the National Women’s Law Center filed an amicus brief arguing that this unprecedented targeting and punishment of Planned Parenthood Federation of America and its member clinics subverts decades of congressional action designed to increase Medicaid eligibility among women of reproductive age, enhance coverage of reproductive health services, and ensure that beneficiaries have access to the same providers as individuals with private insurance. It likewise undercuts consistent congressional efforts, beginning in 1972, to improve Medicaid beneficiaries’ access to family planning services.
