Revisiting Managed Care Sanctions

Executive Summary

This issue brief is part of the National Health Law Program’s ongoing work on accountability in Medicaid managed care. It updates our research on Medicaid managed care sanctions by revisiting the states we profiled in 2022. We summarize recent sanctions content from the managed care websites of those states and assess if the sanctioning activity has led to any discernible managed care performance improvement. This paper also introduces Managed Care Program Annual Reports (MCPARs), summarizes their content areas, and delves into an examination of what types of sanctions information each state reports in their MCPARs. Similar to our conclusions in our 2022 research, we again find that financial sanctions imposed on MCOs are very low compared to overall payments and profits to MCOs and that wide variation exists among states in their sanctioning activity.
