Executive Summary
The Affordable Care Act (ACA) allows insurers to phase-in compliance with new consumer protections. Insurer plans with “grandfathered” status are exempt from ACA requirements, such as Essential Health Benefits and no cost preventive screenings and services. But in a recently released “Request for Information (RFI),” the Trump administration is contemplating extending and expanding grandfathered plans. The National Health Law Program submitted comments opposing easing of restrictions on grandfathered plans, emphasizing that noncompliant plans harm people seeking health care.
