Explainer: Texas v. United States – What Did the DOJ Do?

Executive Summary

The Department of Justice earlier this month lodged a legal action in federal court trying to explain why it would no longer defend the Affordable Care Act in ongoing litigation to wipe out the law. National Health Law Program Staff Attorney Joe McLean explains that the DOJ’s legal action is another attempt by the Trump administration to “weaken the ACA and is consistent” with its goal of “reversing progress made by the ACA.”

McLean concludes, in part, “Beyond the impact on the state of health care in this country, it is troubling that the DOJ is effectively abdicating its role to implement the law and arguing instead that the ACA is unconstitutional.”
