Executive Summary

In 2023, Montana imposed severe restrictions on coverage of abortion services for individuals enrolled in Medicaid. Reproductive health providers filed suit, arguing that the restrictions violate the Montana Constitution. The lower court granted the Plaintiffs’ motion for a preliminary injunction, and the State appealed. NHeLP filed an amicus brief to bring information to the Montana Supreme Court about who is eligible for Medicaid due to pregnancy and who will be disproportionately affected by the elimination of coverage for abortion services provided to Medicaid enrollees via telehealth.
