The claim that Gov. Bobby Jindal’s administration is making about Planned Parenthood Gulf Coast’s ability to sue in federal court is not likely to hold up, experts on Medicaid law said Friday (Aug. 28).

Jane Perkins, the legal director of the National Health Law Program in Washington, said in an email that the Jindal administration’s arguments amount to stretching the Supreme Court argument far beyond its bounds.
“The Jindal motion to dismiss is off-base legally,” Perkins said. “It looks like they are attempting to extend the reach of Armstrong far beyond anything the Supreme Court considered or did.”
