Major Litigation Win: Court Rules Tennessee’s Medicaid Program Wrongfully Denied Health Care for Thousands

On August 26, 2024 a federal court handed down a major victory for Medicaid enrollees in Tennessee, including people with disabilities, in the case A.M.C. v. Smith. This victory comes after years of hard-fought litigation, and proves that Tennessee’s Medicaid program, called TennCare, violated their rights under the Medicaid Act, the Constitution’s Due Process Clause, and the Americans with Disabilities Act.

The plaintiffs in the case were represented by the National Health Law Program and our Health Law Partner the Tennessee Justice Center as well as the National Center for Law and Economic Justice, and pro bono firm Selendy Gay, PLLC.

While work remains, this is a huge win for equitable health care access and sets an important precedent for future cases.
