Hernandez v. Medows, Southern District of Florida

Executive Summary

Class of Medicaid recipients challenged Florida’s failure to provide basic due process when denying coverage of prescription drugs. Recipients were simply told by a pharmacist that Medicaid would not pay for a prescription drug, without any written explanation of why coverage was denied, or how they could challenge the decision. Plaintiffs alleged that this practice violated the Medicaid Act and the requirements of constitutional due process.
