Amicus brief from National Health Law Program in CVS v. Doe

Executive Summary

In CVS v. Doe, individuals living with HIV challenge a decision by their health insurers to require access to HIV medications only through mail-order pharmacies while other medications are available in-store with pharmacist consultation available. NHeLP, joined by Disability Rights California, argues in this amicus brief (“friend of the court”) that the Court should consider disability discrimination in health care in light of the ACA’s sweeping changes, which made many long time practices by health insurers unlawful and created Section 1557 as a way to enforce such important changes.
